二 | 比如，2023年7月，中央网信办通报一起“股市小作文”谣言案例，并处置造谣传谣账号。又如，2024年9月，公安机关依法查处一起自媒体运营人员恶意编造涉转融通谣言进行吸粉引流、非法牟利的案件。第一时间澄清、查找切断谣言传播源头、依法处置相关账号和人员、开展“清朗”“净网”等专项行动……监管部门对资本市场谣言的“零容忍”，彰显了净化资本市场信息传播环境、维护资本市场稳定的坚决态度。
三 | 资本市场是一个“信息+信心”的市场，不实谣言、带节奏的“小作文”会严重误导投资者的判断，扭曲资本市场价格信号，影响资本市场功能发挥，极大损害投资者的合法权益。打击资本市场谣言，及时惩治至关重要，有效防范也同样关键。更精准有效地防范打击资本市场谣言，有必要“追根溯源”。
四 | 一篇篇“股市小作文”的诞生，绝非只是恶搞，背后是“无利不起早”，有的甚至已经形成了非法的利益产业链。结合近年来的处罚判决及网络热点情况分析，我们梳理了几类值得重点关注的资本市场典型非法信息传播案例：一是散播虚假信息。比如部分投资者在网站发布虚假政策信息，蛊惑其他投资者交易，扰乱市场秩序，并从中非法获益。二是违规点评荐股。比如一些网络大V直接或变相推荐股票，诱骗投资者购买该公司股票，帮助相关人士获利。三是跟风炒作热点。比如一些自媒体跟风传播谣言、炒作不实热点，获取关注和流量，并收取直播打赏、感谢费等，谋取不正当利益。四是非法提供咨询。比如一些账号在不具备证券投资咨询从业资格及业务资质的情况下，通过微博、微信提供推荐个股、预测行情、指导操作等证券咨询服务，并组建投资咨询群，收取会员费等。认清这些违法传播现象背后的利益链条，不仅有利于投资者提高风险意识、加强防范，也有利于相关各方“对症下药”、精准施力。当然，加强监管、严厉打击不是“一刀切”，还要进一步鼓励相关信息传播者在合法合规前提下，充分发挥贴近性等优势，制造传播优质财经科普内容，从根本上压缩非法信息的网络传播空间，共同营造一个更加清朗的资本市场信息传播环境。
